DUI Laws in Alabama

If you face a pending administrative license suspension due to a DUI arrest, you only have ten days to file an appeal.

What is Drunk in Alabama:

  • Drivers should not have a Blood Alcohol Content (BAC) level of 0.08 percent or higher.

  • Commercial drivers should not exceed a BAC of 0.04 percent.

  • Drivers under the age of 21 cannot have a BAC of more than 0.02 percent.

Potential penalties for a DUI conviction include:

First DUI Offense

For a first DUI offense, you may face fines of up to $2,100, up to one year in jail, a 90-day driver's license suspension, mandatory attendance at DUI school, and installation of an Ignition Interlock Device (IID) in your vehicle, along with a monthly maintenance fee.

Second DUI Offense

For a second DUI offense, you may be required to serve a minimum of 48 hours in jail and potentially up to one year. You could also face fines of up to $5,100, and your driver's license may be revoked for one year.

Third DUI Offense

For a third DUI offense, you may face imprisonment ranging from 60 days to one year and fines of up to $10,000. Your driver's license could be revoked for up to three years.
