Schedule I drugs are deemed the most dangerous and highly addictive, with no accepted medical use according to state law. In comparison, Schedule V drugs have a lower risk of abuse and acceptable medical uses, but even illegal possession of a Schedule V drug can result in serious consequences. Notably, marijuana is classified as a Schedule I drug in Alabama, and both possession and sale attract severe penalties that can significantly affect your life.

Possession of Marijuana

If you are caught with any amount of marijuana intended for personal use, you will be charged with a Class A misdemeanor. This charge can result in up to one year in jail and a maximum fine of $6,000. A conviction for marijuana possession may also lead to a six-month suspension of your driver’s license. If charged with possession of marijuana with the intent to sell, you could face felony charges, carrying a potential sentence of 366 days to 10 years in prison, along with a maximum fine of $15,000.

Sale of Marijuana

Alabama enforces strict drug laws. Selling marijuana, regardless of the amount, results in felony charges and a mandatory minimum sentence ranging from two to twenty years of incarceration. Additionally, you could face a maximum fine of $30,000. The severity of the charges escalates if the sale involves a minor, in which case, you might face a life sentence and a maximum fine of $60,000.
